Welcome to Superfan! These Terms of Use ("Terms") govern your use of Superfan, except where separate terms apply, and provide information about the Superfan service ("Service"), outlined below. By creating a Superfan account or using the Service, you agree to these Terms. If you do not agree to these Terms, you cannot use the Service.
Superfan is a product provided to you by Sparky Tech, Inc. These Terms constitute an agreement between you and Sparky Tech, Inc.
The Superfan Service
We agree to provide you with the Superfan Service. The Service includes all of the products, features, applications, services, technologies, and software that we provide to support Superfan's mission: Connecting fans and artists to share exclusive content and experiences. The Service consists of the following components:
Providing personalized opportunities to create, connect, and share. Superfan enables you to discover artists and music communities, interact with fellow fans, and create content. We use data from your activities on and off Superfan to help you connect with experiences that matter to you, and to tailor features, content, and ads that align with your interests.
Fostering a safe, inclusive community. We strive to make Superfan a positive and supportive platform. Our policies, tools, and resources are aimed at encouraging meaningful connections, while also combating abuse and harmful behavior.
Developing and using technology to enhance your experience. We use technologies like artificial intelligence and machine learning to organize and analyze the vast amount of information within Superfan, enhancing the way we provide a personalized and secure experience.
Ensuring a seamless experience across our platform. We work to provide consistent and cohesive services within the Superfan platform to allow fans and artists to engage without interruptions.
Connecting you with brands and services you care about. We partner with brands and advertisers to deliver content, offers, and ads relevant to you based on your activity on Superfan and elsewhere.
How Our Service Is Funded
By using Superfan, you acknowledge that we can show you ads paid for by businesses and organizations. We use data about your activities and interests to present ads that are more relevant to you. Advertisers do not have access to your personal data, such as your name or email address, without your explicit consent.
Privacy Policy
To provide the Service, we collect and use your information. Our Privacy Policy outlines how we collect, use, and share this information and the ways you can control your data.
Your Commitments
In return for our Service, you make the following commitments:
Who Can Use Superfan
You must be at least 13 years old.
You must not be prohibited from receiving any aspect of our Service under applicable laws.
Your account must not have been previously disabled for violations of law or our policies.
You must not be a convicted sex offender.
Prohibited Activities
You cannot impersonate others or provide inaccurate information.
You cannot do anything unlawful, misleading, fraudulent, or for an unauthorized purpose.
You must not interfere with the functionality or integrity of the Service.
You must not collect information or create accounts in unauthorized ways.
You may not post someone else's private or confidential information without their permission or infringe on others' intellectual property rights.
Permissions You Give to Us
By posting content on Superfan, you grant us a license to use it. We do not claim ownership of your content, but we require certain permissions to operate the Service, including the right to host, display, and distribute your content.
Additionally, you permit us to show your username, profile picture, and actions you take on Superfan in connection with ads or sponsored content that you engage with, without compensation to you.
Content Removal and Account Termination
We reserve the right to remove content or disable accounts if we determine that they violate these Terms or our policies. You can delete your account at any time. Upon deletion, we will start the process of removing your content within 30 days, though certain content may persist for up to 90 days for backup and disaster recovery.
Disputes and Arbitration
By using Superfan, you agree to resolve disputes with us through binding arbitration on an individual basis, and you waive your right to participate in a class-action lawsuit. You may opt-out of arbitration by contacting us in writing within 30 days of agreeing to these Terms.
Liability and Warranties
Superfan is provided "as is." We disclaim all warranties and are not responsible for the content shared by users, including their actions or conduct. Our liability is limited as much as the law permits.
Updating These Terms
We may need to update these Terms occasionally to reflect changes in our Service or policies. We will notify you of significant changes, and your continued use of Superfan after such updates means you agree to the new Terms.
